国際刑事裁判所残余メカニズム（IRMCT）に関する討論における志野大使ステートメント

Thank you, Mr. President.
I thank President Santana and Chief Prosecutor Brammertz for their informative reports and briefings. Japan is committed to promoting the rule of law including the fight against impunity as well as the pursuit of transitional justice, and thus supports the role of the International Residual Mechanism for Criminal Tribunals (IRMCT). We would like to call upon all States to cooperate therewith.
Mr. President,
We welcome that the Mechanism has shown remarkable progress. It not only concluded the core crimes cases last year, but also succeeded in accounting for all fugitives indicated by the International Criminal Tribunal for Rwanda (ICTR) and the International Criminal Tribunal for the Former Yugoslavia (ICTY) in May this year. This achievement would not have been possible without the tenacity and expertise of the fugitive tracking team. We would like to express our sincere respect for their dedication and achievement. We also recognize that the excellent cooperation of the States involved played an important role in achieving this outcome. Our utmost gratitude is extended to them as well.
Mr. President,
With this progress in the areas of investigation and prosecution, we welcome that the Mechanism is now transitioning from an operational court to a truly residual institution. While we acknowledge that the Mechanism continues to have an indispensable role including in assisting national jurisdictions, its activities and size should be narrowed over time commensurate with the reduction in its functions.
In this regard, we appreciate the Mechanism’s leadership toward the earliest completion of its residual functions as well as potential options for transferring its remaining activities. The framework document on the completion of the functioning of the Mechanism, which President Santana presented to the Council in April this year, enabled us to have a clearer understanding on the future activities of the Mechanism, its expected duration, and the possibility and difficulties of transferring its functions. We also commend the President Santana’s internal restructuring initiative, which combines both reducing posts and streamlining workflows in order to optimize resources and efficiencies.

Let me reiterate Japan’s continued interest in and unwavering support for the activities of the Mechanism. We are committed to promote the rule of law together with fellow Member States and international judicial institutions including the IRMCT.
