Statement by H.E. Ambassador MIKANAGI Tomohiro Deputy Permanent Representative of Japan to the United Nations, at the Security Council Arria-Formula Meeting on “Commercial Spyware and the Maintenance of International Peace and Security”

I thank you, Madam Chair.
I thank US for convening this important meeting. Japan, as a co-sponsor, welcomes the opportunity to discuss this issue.
Today, we see growing misuse and abuse of commercial spyware around the world, including in instances that potentially affect international peace and security. This issue requires stronger multilateral collaboration, and the Security Council should pay due attention to the potential risks.
Japan remains committed to fostering a free, fair, and secure cyberspace while upholding universal values such as human rights. Today let me highlight three main points.
First, establishing domestic rules and procedures to prevent misuse of commercial spyware is key.
Japan has amended its criminal code to cope with advanced information processing and crimes related to electronic or magnetic records containing unauthorized commands in response to such malicious activities.
It is vital to share best practices and promote discussions on universally applicable principles among Member States through multilateral fora.
Second, more effective governance must be developed to prevent spyware companies from continuing to supply spyware to malicious users. Given the transboundary nature of cyberspace, this must involve the entire international community.
Commercial spyware often exploits operating systems and applications built by private companies. That is why we should pay attention not only to those who develop and provide commercial spyware, but also to OS and application developers.
Expertise and coordination among all stakeholders should be fully integrated to formulate countermeasures in an inclusive and effective manner.
Third, greater global awareness and actions are greatly needed.
Building on existing initiatives including the Joint Statement on Efforts to Counter the Proliferation and Misuse of Commercial Spyware led by the US, and the Pall Mall Process led by the UK and France, we believe that wider collective deliberations would create greater understanding.
It is imperative to address the issue holistically across various sectors, including by advancing discussions at relevant UN frameworks such as the OEWG and the Human Rights Council.
Madam Chair,
I hope today’s meeting will reinforce recognition of the critical importance of this issue, foster balanced and constructive discussions, and maintain momentum in our collective efforts to combat the misuse of commercial spyware.
